Please read these Terms carefully because they govern your use of the website located at https://klondike-crypto.com (the “Site”) and the services offered by MDI under the brand name Klondike (“Klondike,” “we,” “our,” or “us”). To make these Terms easier to read, the Site and associated services are collectively called the “Services.”

By using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Klondike and MDI retain all rights, title, and interest in and to the Services, including all related intellectual property rights. The Services are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our written consent.

6. General Prohibitions and Enforcement Rights

You agree not to do any of the following:

a) Use, display, mirror, or frame the Services or any part of them without our written consent.
b) Access or attempt to access non-public areas of the Services or our systems.
c) Probe, scan, or test vulnerabilities or breach security measures.
d) Circumvent technological protections we use.
e) Use any scraping, spider, or data-mining tools other than those we provide.
f) Send spam or unauthorized promotional materials.
g) Misuse our name, trademarks, or metadata.
h) Use the Services for unlawful, fraudulent, or unauthorized purposes.
i) Interfere with or disrupt the Services, including introducing malware.
j) Collect or store personal data about other users without permission.
k) Impersonate another person or entity.
l) Violate any applicable law, regulation, or exchange policy.

We are not obligated to monitor use of the Services, but we may do so to operate them, ensure compliance with these Terms, or comply with law. We may remove or disable access to content, suspend accounts, and cooperate with authorities in enforcing the law.

7. Third-Party Services and Exchanges

The Services integrate with third-party centralized exchanges (CEXs) and external data providers. We do not control, endorse, or assume responsibility for:

  • Availability, accuracy, or timeliness of third-party data;

  • Execution of orders on third-party platforms;

  • Content, products, or services on external websites.

Your use of third-party services is at your own risk.

8. Termination

We may suspend or terminate your access to the Services, including your account, at any time, with or without cause or notice. You may cancel your account at any time by contacting us.

Upon termination, provisions of these Terms that by nature should survive will remain in effect, including Sections 4–13.

9. Warranty Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.”
We make no warranties of any kind, whether express or implied, including:

  • Merchantability, fitness for a particular purpose, or non-infringement;

  • That the Services will be uninterrupted, secure, or error-free;

  • That any data, pricing, order book, or pathfinder results are accurate or reliable.

Crypto trading is volatile and risky. You are solely responsible for your trading decisions. Nothing in the Services constitutes financial, investment, or trading advice.

10. Indemnity

You agree to indemnify, defend, and hold harmless MDI, Klondike, and their officers, employees, and agents (collectively, the “Company”) from any and all claims, damages, liabilities, losses, costs, or expenses (including attorneys’ fees) arising from or related to your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Klondike (MDI) provides the Services “AS IS” and “AS AVAILABLE.”

  • We do not guarantee the accuracy, completeness, or reliability of any information, data, or results from using the Services.

  • You use the Services entirely at your own risk.

  • Klondike (MDI) shall not be liable for any losses, damages, costs, or expenses of any kind, including but not limited to financial losses, business losses, data loss, or trading losses.

  • No refunds or compensation will be provided under any circumstances.

By using the Services, you acknowledge and agree that Klondike (MDI) takes no responsibility for any outcomes resulting from your use of the Services.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of France. Any disputes arising under or in connection with these Terms will be resolved exclusively in the courts of Paris, France.

13. General Terms

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of France.

You and Klondike agree that the courts of Paris, France shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
